TransportationPunishment. In the English law, this punishment is inflicted by virtue of sundry statutes; it was unknown to the common law. 2 H. Bl. 223. It is a part of the judgment or sentence of the court, that the party shall be transported or sent into exile. RELATED TERMS-------------------------------------- Punishment Criminal law. Some pain or penalty warranted by law, inflicted on a person, for the commission of a crime or misdemeanor, or for the omission of the performance of an act required by law, by the judgment and command of some lawful court. In contracts, a party is one or more persons who engage to perform or receive the performance of some agreement. Exile Civil law. The name of an action by which a suit, which was pending at the time the parties died, is transferred from the deceased to his representatives, in the same condition in which it stood formerly. If it be the pursuer who is dead, the action is called a transference active; if the defender, it is a transference passive. Transferor One who makes a transfer. Transferring or assigning copyright When an author or other holder of the copyright authorizes another to use a right or rights to a work. The act of taking the cargo out of one ship and loading it in another. Transire English law. A warrant for the custom-house to let goods pass: a permit. Transit alien An alien in immediate and continuous transit through the United States, with or without a visa, including, 1) aliens who qualify as persons entitled to pass in transit to and from the United Nations Headquarters District and foreign countries and 2) foreign government officials and their spouses and unmarried minor (or dependent) children in transit. Transit without visa (TWOV) A transit alien traveling without a nonimmigrant visa under section 233 of the INA. An alien admitted under agreements with a transportation line, which guarantees his immediate and continuous passage to a foreign destination.
