Ratio decidendi




Ratio decidendi

Reason for deciding, which refers to a finding of law in a decision, where the finding was based on the issues properly before the court. It is legal reasoning essential to the decision that the court must take to decide the case.

Reason
By reason is usually understood that power by which we distinguish truth from falsehood, and right from wrong; and by which we are enabled to combine means for the attainment of particular ends

Finding
Practice. That which has been ascertained; as, the ruding of the jury is conclusive as to matters of fact when confirmed: by a judgment of the court.

Decision
Practice. A judgment given by a competent tribunal. The French lawyers call the opinions which they give on questions propounded to them, decisions.

Issues
English law. The goods and profits of the lands of a defendant against whom a writ of distringas or distress infinite has been issued, taken by virtue of such writ, are called issues.

Court
A body in government to which the administration of justice is delegated.

Legal
That which is according to law. It is used in opposition to equitable, as the legal estate is, in the trustee, the equitable estate in the cestui que trust.

Take
This is a technical expression which signifies to be entitled to; as, a devisee will take under the will. To take also signifies to seize, as to take and carry away.

1) Practice. A contested question before a court of justicea suit or action a cause. 2) An agreement in writing, between a plaintiff and defendant, that the facts in dispute between them are as there agreed upon and mentioned

Criminal law. 1) It is an unlawful taking of a woman, or an heir in ward. 2) It is sometimes used synonymously with rape.

Ravishment of ward
English law. The marriage of an infant ward, without the consent of the guardian, is called a ravishment of ward, and punishable by statute.
