Presentence report
Presentence reportA report to the sentencing judge containing background information about the crime and the defendant to assist the judge in making his or her sentencing decision. RELATED TERMS-------------------------------------- Report 1) Legislation. A statement made by a committee to a legislative assembly, of facts of which they were charged to inquire. 2) Practice. A certificate to the court made by a master in chancery, commissioner or other person appointed by the court, of the facts or matters to be ascertained by him, or of something of which it is his duty to inform the court. Judge An elected or appointed public official with authority to hear and decide cases in a court of law. Information 1) An accusation or complaint made in writing to a court of competent jurisdiction, charging some person with a specific violation of some public law. 2) In the French law, the term information is used to signify the act or instrument which contains the depositions of witnesses against the accused. Crime An act or omission which is prohibited by criminal law. Each state sets out a limited series of acts (crimes) which are prohibited and punishes the commission of these acts by a fine, imprisonment or some other form of punishment. In exceptional cases, an omission to act can constitute a crime, such as failing to give assistance to a person in peril or failing to report a case of child abuse. Defendant A party who is sued in a personal action. Decision Practice. A judgment given by a competent tribunal. Presumption of validity An assumption, where there is doubt as to the applicable law, that the parties intended the legal system under which the clause or contract would be valid (in a situation where contract or clause is valid under one legal system, but invalid under another one). Presumptive heir One who, if the ancestor should die immediately, would under the present circumstances of things be his heir, but whose right of inheritance may be defeated by the contingency of some nearer heir being born; as a brother, who is the presumptive heir, may be defeated by the birth of a child to the ancestor.
