Lis

A suit; an action; a controversy in court; a dispute.

Suit
An action. The word suit in the 25th section of the judiciary act of 1789, applies to any proceeding in a court of justice, in which the plaintiff pursues, in such court, the remedy which the law affords him. An application for a prohibition is therefore a suit.

Action
1) French commercial. Stock in a company, shares in a corporation. 2)Civil law. An action instituted to avoid a sale onaccount of some Vice or defect in the thing sold which readers it either absolutely useless, or its use so inconvenient and, imperfect, that it must be, supposed the buyer would not have purchased it, had he known of the vice.

Controversy
A dispute arising between two or more persons.

Court
A body in government to which the administration of justice is delegated.

Liquidated damages
By this term is understood the fixed amount which a party to an agreement promises to pay to the other, in case he shall not fulfil some primary or principal engagement into which he has entered by the same agreement it differs from a penalty.

The defence that a lawsuit is pending elsewhere, between the same parties and concerning the same issues.

Lis mota
The cause of the suit or action. By this term is understood the commencement of the controversy, and the beginning of the suit.

Lis pendens
The pendancy of a suit; the time between which it is instituted and finally decided.

Lisbon rules
A set of rules on the assessment of damages in ship collisions (supra), prepared by the CMI and adopted at Lisbon in 1987. The Rules do not have the force of law, but are intended rather as guidelines for judges, arbitrators, insurers, average adjusters and others concerned with evaluating collision damages. They may also be chosen by the parties to a collision dispute, after it arises, to govern damage assessment.
