Immigration act of 1990

Public Law which increased the limits on legal immigration to the United States, revised all grounds for exclusion and deportation, authorized temporary protected status to aliens of designated countries, revised and established new nonimmigrant admission categories, revised and extended the Visa Waiver Pilot Program, and revised naturalization authority and requirements.

Exclusion
Prior to the Illegal Immigration Reform and Immigrant Responsibility Act of 1996, exclusion was the formal term for denial of an alien’s entry into the United States. The decision to exclude an alien was made by an immigration judge after an exclusion hearing. Since April 1, 1997, the process of adjudicating inadmissibility may take place in either an expedited removal process or in removal proceedings before an immigration judge.

Deportation
Civil law. Among the Romans a perpetual banishment, depriving the banished of his rights as a citizen; it differed from relegation and exile.

Temporary
That which is to last for a limited time; as, a temporary sta-tute, or one which is limited in its operation for a particular period of time after its enactment the opposite of perpetual.

Status
The condition of persons. It also means estate, because it signifies the condition or circumstances in which the owner stands with regard to his property.

Nonimmigrant
An alien who seeks temporary entry to the United States for a specific purpose. The alien must have a permanent residence abroad (for most classes of admission) and qualify for the nonimmigrant classification sought.

Admission
In corporations or companies. The act of the corporation or company by which an individual acquires the rights of a member of such corporation or company.

Visa
A U.S. visa allows the bearer to apply for entry to the U.S. in a certain classification. A visa does not grant the bearer the right to enter the United States. The Department of State (DOS) is responsible for visa adjudication at U.S. Embassies and Consulates outside of the U.S. The Department of Homeland Security (DHS), Bureau of Customs and Border Protection (BCBP) immigration inspectors determine admission into, length of stay and conditions of stay in, the U.S. at a port of entry.

Waiver
When a person disclaims or renounces to a right that they may have otherwise had. Waivers are not always in writing. Sometimes a person's actions can be interpreted as a waiver.

Pilot
Merchant law. 1) An officer serving on board of a ship during the course of a voyage, and having the charge of the helm and of the ship's route; 2) An officer authorized by law, who is taken on board at a particular place, for the purpose of conducting a ship through a river, road or channel, or from or into port.

Naturalization
The act by which an alien is made a citizen of the United States of America.

Authority
Government. The right and power which an officer has in the exercise of a public function to compel obedience to his lawful commands.

If the aliens cannot show that the marriage through which the status was obtained was and is a valid one, their conditional immigrant status may be terminated and they may become deportable.
