Enlistment
EnlistmentThe act of making a contract to serve the government in a subordinate capacity, either in the army or navy. The contract so made, is also called an enlistment. RELATED TERMS-------------------------------------- Contract A negotiated oral or written agreement setting forth the terms for an exchange of value between parties (which may be individuals or companies) and under which each party promises to perform an obligation. Certain terms, such as the obligations to be performed and the terms for setting price or compensation must be mutually understood, known in legal lingo as a "meeting of the minds," and promised to by the parties to form a legal contract. Government "natural and political law. The manner in which sovereignty is exercised in each state. There are three simple forms of government, the democratic, the aristocratic, and monarchical. But these three simple forms may be varied to infinity by the mixture and divisions of their different powers. It is taken in this sense when the government is spoken of in opposition to other bodies in the state. Capacity This word, in the law sense, denotes some ability, power, qualifi- cation, or competency of persons, natural, or artificial, for the performance of civil acts, depending on their state or condition, as defined or fixed by law; as, the capacity to devise, to bequeath, to grant or convey lands; to take; or to take. and hold lands to make a contract, and the like. Navy The whole shippings taken collectively, belonging to the government of an independent nation; the ships belonging to private individuals are not included in the navy. Tends to invalidate oral agreements as well as undated side agreements or attachments unless specifically incorporated. Such a clause doesn't prevent the parties from making subsequent changes to a contract, but any changes should be in a writing dated and signed by all parties.
