Duke




Duke

The title given to those who are in the highest rank of nobility in England.

Title
1) Estates. A title is defined by Lord Coke to be the means whereby the owner of lands hath the just possession of his property. 2) Legislation That part of an act of the legislature by which it is known, and distinguished from other acts the name of the act. 3) Rights. The order or place in which certain officers are placed in the army and navy, in relation to others, is called their rank.

Nobility
An order of men in several countries to whom privileges are granted at the expense of the rest of the people. The constitution of the United States provides that no state shall " grant any title of nobility; and no person can become a citizen ot' the United States until he has renounced all titles of nobility."There is not in the constitution any general prohibition against any citizen whomsoever, whether in public or private life, accepting any foreign title of nobility. An amendment of the constitution in this respect has been recommended by congress, but it has not been ratified by a sufficient number of states to make it a part of the constitution.

Due diligence
The process by which a purchaser of or an investor in a company or business investigates the records of the target to support its value and find out whether there are "skeletons in the cupboard". Due process is frequently utilized to control a choice of jurisdiction.

Due process of law

It includes such constitutional requirements as adequate notice, assistance of counsel, and the rights to remain silent, to a speedy and public trial, to an impartial jury, and to confront and secure witnesses.

An acknowledgment of a debt, in writing, is so called.

Criminal law. The fighting of two persons, one against the other, at an appointed time and place, upon a precedent quarrel.

Dum casta
Latin: for so long as she remains chaste. Separation agreements years ago used to contain dum casta clauses which said that if the women were to start another relationship, she forfeited her entitlement to maintenance.

Dum fuit infra aetatem
The name of a writ which lies when an infant has made a feoffment in fee of his lands, or for life, of a gift in tail.

Dum non fuit compos mentis
English law. The name of a writ, which the heirs of a person who was non compos mentis, and who aliened his lands, might have sued out, to restore him to his rights.

Dum sola
While single or unmarried. This phrase is applied to single women, to denote that something has been done, or may be done, while the woman is or was unmarried.

Dum vidua
Latin: for so long as she remains a widow.
