Asylee




Asylee

An alien in the United States or at a port of entry who is found to be unable or unwilling to return to his or her country of nationality, or to seek the protection of that country because of persecution or a well-founded fear of persecution. Persecution or the fear thereof must be based on the alien’s race, religion, nationality, membership in a particular social group, or political opinion. For persons with no nationality, the country of nationality is considered to be the country in which the alien last habitually resided.

Contracts, remedies. Persons who are beyond the sea are exempted from the operation of the statute of limitations of Pennsylvania, and of other states, till after a certain time has elapsed after their returning.

Nationality
The state of a person in relation to the nation in which he was born.

Protection
1) English law. A privilege granted by the king to a party to an action, by which he is protected from a judgment which would otherwise be rendered against him. 2) Government. That benefit or safety which the government affords to the citizens. 3) merc. law. The name of a document generally given by notaries public, to sailors and other persons going abroad, in which is certified that the bearer therein named, is a citizen of the United States.

Fear
Criminal law. Dread, consciousness of approaching danger.

Religion
Real piety in practice, consisting in the performance of all known duties to God and our fellow men.

Political
Pertaining to policy, or the administration of the government. Political rights are those which may be exercised in the formation or administration of the government they are distinguished from civil, rights, which are the rights which a man enjoys, as regards other individuals, and not in relation to the government. A political corporation is one which has principally for its object the administration of the government, or to which the powers of government, or a part of such powers, have been delegated.

Opinion
1) Practice. A declaration by a counsel to his client of what the law is, according to his judgment, on a statement of facts submitted to him. The paper upon which an opinion is written is, by a figure of speech, also called an opinion. 2) Evidence. An inference made, or conclusion drawn, by a witness from facts known to him. 3) Judgment. A collection of reasons delivered by a judge for giving the judgment he is about to pronounce the judgment itself is sometimes called an opinion.

Habitually
Customarily, by habit. or frequent use or practice, or so frequently, as to show a design of repeating the same act.

The concept in employment law that says an employee serves "at the will" of the employer and can be terminated with or without cause. The concept has been modified by labor law and is not applicable to independent contractors who perform and are paid according to the terms of their contract.
