AssumpsitContracts. An undertaking either express or implied, to perform a parol agreement.

Contracts. An engagement by one of the parties to a contract to the other, and not the mutual engagement of the parties to each other; a promise.
Express
That which is made known, and not left to implication. The opposite of implied. It is a rule, that when a matter or thing is expressed, it ceases to be implied by law: expressum facit cessare tacitum.

More properly parole. A French word, which means literally, word or speech. It is used to distinguish contracts which are made verbally or in writing not under seal, which are called, parol. contracts, from those which are under seal which bear the name of deeds or specialties
