Aberemurder

AberemurderObsolete. An apparent, plain, or downright murder. It was used to distinguish a willful murder, from a chance-medley, or manslaughter.

Apparent
That which is manifest what is proved. It is required that all things upon which a court must pass, should be made to appear, if matter in pays, under oath if matter of record, by the record. It is a rule that those things which do not appear, are to be considered as not existing de non apparentibus et non existentibus eadem est ratio.
Murder
"1) Pleadings. In an indictment for murder, it must be charged that the prisoner ""did kill and murder"" the deceased, and unless the word murder be introduced into the charge, the indictment will be taken to charge manslaughter only. Criminal law. The unlawful killing of another without malice either express or implied. The distinctions between manslaughter and murder, consists in the following. In the former, though the act which occasions the death be unlawful, or likely to be attended with bodily mischief, yet the malice, either express or implied, which is the very essence of murder, is presumed to be wanting in manslaughter.
